DODGE KING PTY LTD — APPLICATION TERMS OF USE

1. ACCEPTANCE OF TERMS

By downloading, installing or using the Dodge King mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User") and Dodge King Pty Ltd ("Company", "we", "us", "our"), a company incorporated in New South Wales, Australia.

2. ELIGIBILITY

The App is available to users aged 13 years and older. Users aged 13–17 must have parental or guardian consent. The Weekly Draw is open to users aged 18 and older only.

3. LICENCE

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on a device you own or control, solely for personal, non-commercial purposes. You must not:

  • Copy, modify, distribute, sell or lease any part of the App
  • Reverse engineer or attempt to extract the App's source code
  • Remove or alter any proprietary notices on the App
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorised access to the App's systems
4. IN-APP ADVERTISING

The App displays advertisements from third-party ad networks including IronSource/Unity LevelPlay and Google AdMob. By using the App you acknowledge that ad networks may collect data per Part C (Privacy Policy). We are not responsible for third-party ad content. Ad personalisation is subject to your iOS ATT consent.

5. INTELLECTUAL PROPERTY

All intellectual property rights in the App — including the game engine, graphics, audio, DODGE KING name and crown logo — are owned by or licensed to Dodge King Pty Ltd. All rights reserved.

6. DISCLAIMER & LIMITATION OF LIABILITY

The App is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our aggregate liability to you shall not exceed AUD $100. Nothing herein excludes liability under the Australian Consumer Law.

7. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

DODGE KING PTY LTD — WEEKLY DRAW RULES

2. THE PROMOTION

The Dodge King Weekly Draw is a free-to-enter trade promotion lottery. No purchase is necessary to enter or win. Each draw period runs Monday 12:00am AEST to Sunday 11:59pm AEST.

3. ELIGIBILITY

Open to residents of eligible jurisdictions aged 18+. Not eligible:

  • Employees, directors and contractors of Dodge King Pty Ltd
  • Immediate family members of the above
  • Persons under 18 years of age
  • Residents of jurisdictions where prohibited by law
4. HOW TO ENTER

In-app: Score 10+ gaps in a single game during the draw period, then sign in with Apple (one time only). Each additional qualifying score = one additional entry. No entry cap per week.

Alternative Method of Entry (AMOE): Email enter@dodgeking.app with your full name, country of residence, date of birth and the words "Weekly Draw Entry". One AMOE entry per person per draw period. No purchase necessary.

5. PRIZE

One (1) prize per draw period: AUD $500. Paid by bank transfer (Australian recipients) or PayPal (international) within 14 days of winner confirmation. Non-transferable, non-exchangeable. Winners responsible for applicable taxes.

6. WINNER SELECTION

Random electronic draw from all eligible entries each Sunday AEST using a cryptographically secure random number generator. Result is final.

7. WINNER NOTIFICATION

Winner notified via in-app push notification and email within 48 hours. Must respond within 14 days or prize is forfeited and a new winner selected. Winner's first name, initial and country published in-app and on social media.

8. AUSTRALIAN STATE REQUIREMENTS

NSW (Trade Promotions Act 1967), ACT (Lotteries Act 1964), SA (State Lotteries Act 1966): Permits will be obtained prior to launch in each jurisdiction where required. All other states: conducted in compliance with applicable legislation.

9. GENERAL CONDITIONS

The Company is not responsible for late, lost or misdirected entries. The Company reserves the right to modify, suspend or cancel the Promotion if it cannot be conducted as anticipated for reasons beyond reasonable control. Nothing herein excludes rights under the Competition and Consumer Act 2010 (Cth).

  • Country of residence — for Draw eligibility and prize fulfilment

2. HOW WE USE YOUR INFORMATION

To operate and improve the App; administer the Weekly Draw and notify winners; serve and measure advertising; comply with legal obligations; prevent fraud. We do not sell personal information to third parties.

Draw entry records retained for minimum 12 months for audit purposes. Personal information deleted on request except where retention is legally required.

6. YOUR RIGHTS UNDER THE APPs

You have the right to access, correct and complain about our handling of your personal information (APPs 12, 13, 1.4). Contact: legal@dodgeking.app. Complaints may also be lodged with the OAIC at oaic.gov.au.

7. CHILDREN'S PRIVACY

The Weekly Draw is for users 18+ only. We do not knowingly collect personal information from children under 13. Contact legal@dodgeking.app if you have concerns.
